Terms of Service

1. Acceptance

By accessing xtallo.com or app.xtallo.com you agree to these Terms, our Privacy Policy, Community Guidelines, and referenced policies. These Terms constitute an electronic record under the Information Technology Act, 2000 and do not require a physical signature. If you do not agree, do not use the Services.

2. Eligibility & accounts

You must be at least 18 years old and competent to contract under the Indian Contract Act, 1872. You are responsible for your credentials and all activity under your account. Provide accurate information and keep it current.

3. Truthfulness of claims

Xtallo is a proof platform. You must not submit false, misleading, exaggerated, or plagiarised claims, evidence, endorsements, or reviews. We may reject, remove, or revoke verification of any content and may suspend or terminate accounts that violate this clause. See our Review Policy.

4. Your content & licence

You retain ownership of content you submit. You grant XDQ Labs Private Limited a worldwide, non-exclusive, royalty-free licence to host, process, display, and distribute that content as needed to operate and promote the Services, consistent with your visibility settings.

5. Our intellectual property

The Xtallo name, logo, platform, software, Trust Score methodology, and related IP belong to XDQ Labs Private Limited. You may not copy, scrape, reverse-engineer, or create derivative works without our written permission.

6. Acceptable use

• No impersonation, fraud, or misrepresentation of affiliation.
• No automated scraping, bulk extraction, or interference with the Services.
• No unlawful, infringing, defamatory, obscene, or harassing content, or content prohibited under Rule 3(1)(b) of the IT Rules, 2021.
• No attempts to manipulate Trust Scores, verification, matching, or reviews.

7. Paid plans

Paid subscriptions (Pro, Elite Talent, Enterprise) are billed as described at purchase, in INR plus applicable taxes. Cancellations and refunds are governed by our Refund & Cancellation Policy.

8. Third-party links & services

The Services may link to third-party sites or integrate third-party services. We are not responsible for their content, policies, or practices.

9. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind. Verification reflects our review at a point in time and is not a guarantee of any person’s or company’s future performance. See our Disclaimer.

10. Limitation of liability

To the maximum extent permitted by law, XDQ Labs Private Limited is not liable for indirect, incidental, special, or consequential damages, and our aggregate liability for any claim is limited to the amount you paid us in the twelve months preceding the claim.

11. Indemnity

You agree to indemnify and hold harmless XDQ Labs Private Limited and its officers, employees, and partners from claims arising out of your content, your use of the Services, or your breach of these Terms.

12. Termination

You may close your account at any time. We may suspend or terminate access for breach of these Terms, with notice where practicable. Clauses that by nature should survive termination will survive.

13. Governing law & jurisdiction

These Terms are governed by the laws of India. Subject to applicable consumer-protection law, the courts at Gurugram, Haryana shall have exclusive jurisdiction. Nothing here limits mandatory consumer rights under the Consumer Protection Act, 2019.
