AI calling compliance: TCPA, PECR and TRAI in plain terms
Automated calls are regulated everywhere, differently. This is the plain-language version of what the rules in the US, UK and India require of an AI caller — disclosure, consent, hours, registries, and do-not-call.
Disclosure: saying it is an AI, and when
First sentence, before anything else, in a fixed line the model cannot alter. Several US states require it; the EU AI Act requires it from 2026; it is best practice everywhere. A person who learns halfway through that they were talking to an AI does not remember anything else about the call.
Consent: what counts, and what a purchased list is
An existing customer relationship, a form the person filled in, an enquiry they made, or written consent for an automated voice. A list somebody bought is none of these, and in the US the TCPA treats an AI voice like a pre-recorded one: prior express written consent, or a per-call violation.
Calling hours and attempt caps by country
Broadly 9am to 9pm local in the US, 8am to 9pm in the UK, 9am to 9pm in India, and not on public holidays. Three attempts in a week is a defensible cap everywhere. The right software refuses to dial outside these rather than warning.
Do-not-call registries: TCPA, TPS, NCPR
The US National Do Not Call Registry, the UK Telephone Preference Service, and India’s National Customer Preference Register. A number on the registry may not be cold-called regardless of what your own records say. Scrubbing against them is the caller’s responsibility.
